Lawsuit Challenges Six-Unit Condo at 3819 West End Avenue
The Whitland Area Neighborhood Association is suing over the zoning appeal that approved The Stately West End, a six-unit condo at 3819 West End Avenue.

The Whitland Area Neighborhood Association filed suit in Davidson County Chancery Court on October 6, challenging the zoning appeal that approved The Stately West End, a four-story, six-unit condominium at 3819 West End Avenue. Defendants include Metro Nashville/Davidson County, Jerome Tannenbaum, Stately West End LLC, and Home Makers, Inc.
The 25,000-square-foot project rises 54 feet on a 0.30-acre site adjacent to the Whitland neighborhood, about 2.5 blocks east of the Montgomery Bell Academy campus. Stately West End LLC is developing, with design by Mitchell Barnett Architect.

The building replaces The Kimberly, a 10-unit, two-story modernist apartment building built in 1963. Plans call for two residences each on floors two and three, one unit on level one, and one residence with extra terrace space on the fourth floor.
The 54-foot height exceeds the prior 35-foot West End Avenue height limit by 19 feet. The city confirmed in 2021 that it no longer enforces that limit.
